By accessing or using Golden Hour CRM ("the Service") at goldenhourcrm.com you agree to be bound by these Terms of Service. If you do not agree to these terms do not use the Service.
These terms apply to all users of the platform including photographers, studio owners, and any other individuals who access the Service.
Golden Hour CRM is a client relationship management platform designed for photography professionals. The Service includes tools for managing clients and leads, sending invoices and contracts, scheduling sessions, email communications, workflow automation, and related features.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of all content you upload or create within the Service including client data, images, email templates, contracts, and invoices ("Your Content").
By using the Service you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.
You are solely responsible for Your Content and represent that you have all necessary rights to upload and use it within the platform. You must not upload content that infringes on the intellectual property rights of others.
When you store your clients' personal information in Golden Hour CRM you are responsible for:
Golden Hour CRM processes client data on your behalf as a data processor and is not responsible for your compliance with applicable data protection laws.
Certain features of Golden Hour CRM require a paid subscription. By subscribing you agree to pay the fees associated with your selected plan.
Payments made by your clients through the platform are processed directly by Stripe on behalf of your studio. Golden Hour CRM is not a party to those transactions and is not responsible for payment disputes between you and your clients.
Golden Hour CRM integrates with third-party services including Stripe, Google Calendar, Twilio, and others. Your use of these integrations is subject to the respective terms and policies of those third parties.
When you connect a third-party account you authorize us to access and use that account as described during the connection process. You can disconnect integrations at any time from your Settings page.
We are not responsible for the availability, accuracy, or conduct of third-party services.
The Service and its original content, features, and functionality are and will remain the exclusive property of Golden Hour CRM and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
You may not copy, modify, distribute, sell, or lease any part of the Service or included software without our express written permission.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant that defects will be corrected or that the Service is free of viruses or other harmful components.
To the maximum extent permitted by law, Golden Hour CRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, data, or goodwill arising from your use of the Service.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify and hold harmless Golden Hour CRM, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses including reasonable legal fees arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any rights of another party.
We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms or if we determine in our sole discretion that termination is appropriate.
You may terminate your account at any time by contacting us or using the account deletion option in your Settings. Upon termination your right to use the Service will cease immediately.
Provisions of these Terms that by their nature should survive termination will survive including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in California, except that either party may seek injunctive relief in a court of competent jurisdiction.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by displaying a prominent notice in the platform at least 14 days before the changes take effect.
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
